This resource may help be useful to anyone involved in the criminal legal system who may have brain injury, cognitive impairment, memory challenges, or communication difficulties, and for the professionals supporting them.

Use this resource when bail conditions are issued, changed, reviewed, or need to be remembered before court, supervision meetings, or release planning.

Access for clients at court, bail supervision, detention/release planning, shelters, hospitals, clinics, or community programs.

Complete it with the person using their bail order, explain each condition plainly, check understanding, and give them a copy to review regularly.

The prevalence of brain injury is exceptional high among people who are affected by bail, probation, parole and incarceration with estimates ranging from 36 to 88%.

The HELPS Brain Injury Screening Tool is a short screener that can help determine if a person has had exposure to a brain injury in their lifetime. The screening does not provide diagnosis or even indicate the absence of a brain injury. If there is a positive result additional assessment with a trained professional may be warranted. 

The screener can help guide guide referrals and accommodations.

SOAR HELPS Screener

The SOAR HELPS Brain Injury Screening Tool can identify survivors of intimate partner violence who've experienced, or may be at risk for, a brain injury.

The SOAR HELPS Tool does not make a diagnosis. It does provide a way to talk about head injury in the context of intimate partner violence, and can help survivors identify the source of some of their challenges.

Each courthouse has an Accessibility Coordinator to support in person and virtual accessibility needs for people visiting court. Disability services relate to a range of conditions such as like hearing, deafness, mobility, developmental, learning, cognitive, mental health, and vision.

Supports may include assistive, interpreters, listening devices, temporary wheelchairs, and real-time captioning.

Accessibility Coordinator 

The program -- located at the Toronto Regional Bail Centre -- provides Navigational support to women who screen for probable brain injury or who have a historical diagnosis of brain injury.

Navigators develop support plans depending on each woman's individualized cognitive-communication, health, and legal needs (e.g., court debriefs, reminders on court dates and meeting bail conditions, health and housing connections).

Registry

A communication intermediary is a trained speech language patholgist who is trained to facilitate two-way communication between individuals with disabilities and legal professionals.

They are neutral officers of the court, like language translators. The are hired and paid for by the end users (e.g., police, RCMP, crown, court, defense counsel). They do not act as a witness, mediator, advisor, or advocate. They assist victims, witnesses and accused people who have speech and language disabilities to understand questions and to communicate answers effectively when communicating with legal professionals.

Description

1. Find out what you need to know about your client (e.g., medical history,  disabilities). 

2. Research/interview CIs. Who will pay (e.g., court, police)? 

3. Get a client assessment, full report with recommendations.

4. Prepare your s.6(2) Canada Evidence Act application. Who else will be be called on the application (parents, caregivers, experts)?

5. If s.6(2) is granted, will the CI help prepare for meetings with the client? 

6. Discuss process with the CI before trial. Encourage the judge to develop a procedure (useful on appeal).
