The Passion Fund is run by Linktree Pty Ltd and as a condition of entry to the competition to determine the recipient(s) of the Fund(s), the applicant (“You”) will be bound by the following Terms and Conditions.
Linktree - the market leading linking platform - is offering the chance for selected recipients to receive a one-time cash payment to assist their passion pursuit, as well as the chance, at Linktree’s discretion, to have their work featured on Linktree’s website and social media posts.
The Passion Fund offers Linktree the opportunity to showcase the exceptional entrepreneurship and innovative thinking of Linktree users in monetizing their passion.
Chance plays no part in determining the winner. Each entry will be individually judged, and the winners will be chosen based on merit.
In these Terms and Conditions, “Fund” refers to the monetary prize to be awarded to the winner(s) of this competition and “the Passion Fund” refers to the competition to determine the winner(s) of the Fund(s).
The grantor is Linktree Pty Ltd (ACN 608 721 562) of 37 Islington Street, Collingwood, Victoria, Australia, 3066 (“Grantor”, “We”, “Us”).
To apply for the Passion Fund you must:
Enter your application via the Linktree Passion Fund submission portal (accessible here).
Provide true and accurate personal and/or business information in response to any questions or prompts included on the submission portal.
Complete a written submission in accordance with the instructions on the submission portal including any word limits, addressing any prompts or questions and the key selection criteria.
Upload an application video or audio file in accordance with the instructions on the submission portal including verifiable date of creation, file size requirement and time limits. Your video or audio submission must have been created within the past 2 months (and it is the right of the Grantor to ask for proof). If the video or audio features a group, all members of the group are to be employees/owners or otherwise directly involved in the running of the business or project and you must have their consent to participate in the video or audio, as well as any reasonable marketing and editorial activities relating to the Passion Fund.
2. The grantor will select a total of (30) Fund winners across Gold (9), Silver (10), Bronze (10). The People's Choice (1) category will be selected by the public, based on the highest number of votes.
3. Voting for the People’s Choice award will be facilitated through the Submittable platform. The winner will be the entrant with the most votes. See the Judging paragraph below for more information on how People’s Choice is shortlisted and awarded.
4. Throughout the course of the Passion Fund, entrants will participate and cooperate as required with all reasonable marketing and editorial activities relating to the Passion Fund, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledge that the grantor may use any such marketing and editorial material without further reference or compensation to them.
5. The entrants agree to grant the Grantor a perpetual, worldwide, non-exclusive, royalty-free licence to: (a) include any materials from the entrant’s submission in the Grantor’s marketing campaigns and publications; and (b) use their name, image, voice, and likeness in any and all media for the purposes of promoting the Passion Fund or any future fund or competition.
6. Anything included in your application may be used for the purposes of judging, so you must ensure that you are comfortable that the information you provide in your application (aside from personal information) may be publicly available for the purpose of selecting the winner.
Entrants must be over the age of 18 and eligible to enter this competition in accordance with the laws of the country in which the entrant resides.
The entrant must own and operate a Linktree account that complies with our Terms and Conditions set out at https://linktr.ee/s/terms.
Entrants must reside in one of the eligible countries listed in the submission form to enter.
Directors and employees of the Grantor, and affiliated talent, and its related companies and their immediate family members are ineligible to enter.
Eligible entrants must submit their entry during the Entry Period (defined under “When to enter”) by submitting their entry using the form available at https://passionfund.linktr.ee/
Entries must include your:
Public facing business social media handles (IG, website, Facebook, LinkedIn, etc)
Linktree profile associated with your passion project or business
Proof of identity
6. The entry must be your original work and must not infringe any third party’s intellectual property rights. If the entry contains any third party intellectual property, it is your responsibility to ensure that you have the requisite consent to use it in the entry, and you must ensure that Linktree has the right to use the entry in accordance with these Terms and Conditions. If an entry is found to be plagiarized, whether wholly or partly, it will be treated as invalid. This clause operates despite any communication of the result of the competition.
7. The submission must be completed in English to be eligible.
8. There is no entry fee.
The application period commences on (27 May 2021 at 12am AEST) date and closes (7 July at 11:59pm AEST) (“Entry Period”). All times noted in these Terms and Conditions are based on Melbourne, Australia time.
People’s Choice voting will open on 21 July 2021 at 12am AEST and closes on 3 August 2021 at 11.59pm AEST. See the Judging paragraph below for details on how People’s Choice category is shortlisted and selected.
Eligible entrants can enter once per business, or if the entrant is an individual, once per person. The first entry received by the Grantor will be the only entry that is eligible for the competition. The Grantor will not review or consider, or substitute, any subsequent entries from an entrant who has already submitted a valid entry.
There will be (30) winners.
The winners of the Fund will be selected on the basis of best video and best written entry by a panel of judges selected by the Grantor. Each submission will be assessed on the Fund’s core values including:
Submissions will also be reviewed for their commercial potential and verified for accuracy of information. Judging will take place from 8 July 2021 at 12am AEST - 3 August 2021 at 11:59pm AEST.
The judges’ decision in relation to any aspect of the Passion Fund is final and binding on each person who enters. Chance plays no part in determining any winner. No responsibility is accepted for late, lost or miscredited entries.
The People’s Choice category will be shortlisted by the Grantor based on the same criteria as the other winners (see section 2 above) The People’s Choice shortlisting will go as follows;
The shortlisted People’s Choice recipients will be contacted by the Grantor via email.
Each shortlisted People’s Choice recipient will have access to a web page that they can share with their audience to encourage voting.
The voting period will open no later than 21 July 2021 at 12am AEST and will end on August 3 2021 at 11:59pm AEST (“Voting Period”).
During the Voting Period, the public will vote and the winner will be selected by highest number of votes.
The total Fund value is $250,000 USD and winners will be distributed a share of this amount depending on which award category they receive;
Gold tier recipients will be paid $20,000 USD each and will be paid out by the Grantor in 3 equal instalments during a 12 month period, with the first payment on or around 30 August 2021, the second payment on or around 30 December 2021, and the final payment on or around 30 April 2022 . Payment will be made directly to the bank account provided by each of the eligible winners. The bank account must be associated with the registered business of the winner.
Silver tier recipients will be paid $4,000 USD each and will be paid out by the Grantor in 3 equal instalments during a 12 month period, with the first payment on or around starting 30 August 2021, the second payment on or around 30 December 2021, and the final payment on or around 30 April 2022. Payment will be made directly to the bank account provided by each of the eligible winners. The bank account must be associated with the registered business of the winner, or be registered in the name of the entrant for entrants who are not a registered business.
Bronze tier recipients will be paid $1,000 USD each and will be paid out by the Grantor in 1 instalment during a 12 month period starting (on or around 30 August 2021). Payment will be made directly to the bank account provided by each of the eligible winners. The bank account must be associated with the registered business of the winner, or be registered in the name of the entrant for entrants who are not a registered business.
The People’s Choice recipient will be paid $20,000 USD and will be paid out by the Grantor in 3 equal instalments during a 12 month period, with the first payment on or around 30 August 2021, the second payment on or around 30 December 2021, and the final payment on or around 30 April 2022. Payment will be made directly to the bank account provided by each of the eligible winners. The bank account must be associated with the registered business of the winner, or be registered in the name of the entrant for entrants who are not a registered business.
The prizes above will be paid to the entrant and into a single bank account only.
The Grantor may also award supplementary prizes for runner up applicants as determined in its discretion.
The Grantor accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regard to the tax implications relating to the Fund or acceptance of the Fund. The entrant is solely responsible for meeting all tax obligations in relation to the Fund.
The Grantor is not liable for any loss, damage, or injury suffered (even if caused by negligence) as a result of any winner accepting and/or using the Fund, except for any liability that cannot be excluded by law.
The prize (including the Fund) is not transferable to any other person and may not be substituted for any other prize.
Winning applicants will be notified via email on or before 10 August 2021 of their successful application and it is the right of the Grantor to verify their identity. The winners agree to keep the result of the competition strictly confidential until such time as the Grantor shall specify. For the avoidance of doubt, the winner will not be permitted to tell any person that they have won until the Grantor provides them approval.
The winners agree to their name and country being published across Linktree’s online channels and promoted via the judges’ social media channels.
Winning entrants agree that the Fund constitutes a series of cash instalments to be paid within a 12 month period and in no way constitutes a partnership, joint venture or employment relationship with the grantor or any associated third-party.
Over the Term of the Fund, winning entrants will participate and cooperate as required with all reasonable marketing and editorial activities relating to the Passion Fund, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledge that the Grantor may use any such marketing and editorial material without further reference or compensation to them. These may include press releases or general outreach activities associated with the Passion Fund or promotional material for future iterations of the Passion Fund. This content remains the property of the Grantor and cannot be returned.
The Grantor reserves the right, in its sole discretion, to disqualify any winning entrant, at any time within the Term of the Fund, where the Grantor has reason to believe such winning entrant has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct to jeopardise the fair and proper conduct of the Passion Fund.
The Grantor reserves the right to disqualify any winning entrant who lives in a jurisdiction that restricts them from entering into and being awarded the Passion Fund prize.
If the Grantor is unable to contact the winner to claim the Fund, or the winner does not accept the Fund (including where the Fund payment does not clear in the winner’s bank account and bounces back) within 6 weeks of the announcement of the winner, the winner will forfeit their share of the Fund in its entirety and such share of the Fund shall be awarded to the runner up entrants from the People’s Choice category in the Passion Fund.
The Grantor accepts no responsibility for any failure to receive an entry to the Fund, or for inaccurate information provided by the entrant, or for any loss, damage or injury as a result of a technical or telecommunications problem, including security breach.
The entrant agrees and acknowledges that they have read these Terms and Conditions and that entry into the Passion Fund is deemed to be acceptance of these Terms and Conditions, in full. It is the responsibility of the entrant to ensure that they are legally eligible to enter this competition, and no prize will be awarded to an entrant that is not legally entitled to receive the prize in accordance with the laws in the country in which they reside.
The Grantor reserves the right in its sole discretion to disqualify any individual, without correspondence, who the Grantor has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct to jeopardise the fair and proper conduct of the Passion Fund. Disqualified entrants are ineligible to receive funds.
Any eligible entrant who tampers or interferes with the entry mechanism in any way, engages in unlawful or improper conduct which jeopardises, or is likely to jeopardise the fair or proper conduct of the Passion Fund, or who does not properly comply with the entry process, will be disqualified and ineligible to receive the Fund or enter further similar programs run by the Grantor.
All entrants must only submit their own original work. Any such work cannot be previously published in any forum worldwide. All entries become the property of the Grantor and cannot be returned. Entries that are found to have derived from a third party will be considered invalid and, if awarded the Fund, the Fund value must be returned to the Grantor.
The entrant agrees not to submit any video or written content that is in any way obscene, defamatory, harassing, unlawful or infringes upon the rights of any third parties.
If the Passion Fund is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Grantor, the Grantor reserves the right, in its sole and absolute discretion and to the fullest extent permitted by law: (a) disqualify any entrant or claimant; or (b) modify, suspend, terminate or cancel the Passion Fund, as appropriate, including by modifying these Terms and Conditions.
Failure by the Grantor to enforce any of its rights at any stage does not constitute a waiver of these rights.
The competition and these Terms and Conditions are subject to and governed by the laws of the State of Victoria, Australia.
